Terms of service
1. About these terms
These terms apply to every order placed through pouchhut.co.nz ("Pouchhut", "we", "us"). Pouchhut is a trader supplying goods in trade. By placing an order you accept these terms, our Shipping & Delivery policy, our Returns & Refunds policy and our Privacy policy.
2. Who can order
You must be 18 or older, ordering for your own personal use, with a delivery address in New Zealand. We may cancel any order where we reasonably believe these conditions are not met, and we may ask for proof of age before dispatch or delivery.
3. Where the goods come from
All products are held at and dispatched from our overseas fulfilment warehouse and shipped internationally to your New Zealand address. No stock is held or dispatched in New Zealand. You are the importer of the goods into New Zealand and are responsible for complying with New Zealand import requirements, including the personal-use quantity guideline (generally up to three months' supply). See Important information for New Zealand customers.
4. Orders and payment
- Prices are in New Zealand dollars. The shipping charge is shown at checkout before you confirm.
- Payment is by New Zealand bank transfer. Your order confirmation email contains the account details and your order number, which you must use as the payment reference.
- Your order is reserved for 7 days from the time it is placed. If payment has not arrived by then, the order is cancelled automatically and any stock is released. You are welcome to place a new order.
- A contract of sale is formed when we confirm your payment has been received. Until then we may cancel an order for any reason, including a pricing or stock error, and refund any amount paid.
- We may limit order quantities to amounts reasonable for personal use.
5. Delivery and risk
Delivery estimates are set out in the Shipping & Delivery policy and are estimates only. Risk in the goods passes to you when the courier records delivery to your address. International parcels may be inspected, delayed or detained by border agencies; we are not responsible for delays caused by border processing, and any duties, taxes or fees assessed on arrival are your responsibility.
6. Your consumer rights
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Our Returns & Refunds policy explains how we handle faulty, damaged, incorrect or missing items.
7. Product information
Product pages state nicotine strength, pouch count and flavour as supplied by the manufacturer. Nicotine is an addictive substance. Our products are not medicines and are not sold as smoking-cessation products. Nothing on this site is health or medical advice.
8. Accounts and site use
You are responsible for keeping any account details secure. Do not use the site for anything unlawful, do not attempt to buy on behalf of a person under 18, and do not scrape or copy site content for commercial use.
9. Liability
To the extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss.
10. Privacy
We handle personal information under our Privacy policy and the Privacy Act 2020.
11. Changes and governing law
We may update these terms; the version on the site when you order applies to that order. These terms are governed by New Zealand law, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
